2. Terms and conditions of use of the website and services offered.

The use of the website implies full and complete acceptance of the general terms and conditions of use described below. These terms of use may be amended or supplemented at any time. Users of the website are therefore advised to consult them regularly.

This website is ordinarily accessible to users at all times. EKIM may however decide to suspend access to the website in order to carry out technical maintenance, in which case it will endeavor to inform users in advance of the dates and times of any such interventions.

The website is regularly updated by Philippe Goldman. In the same way, the legal notices may be amended at any time: they are nevertheless binding on the user who is advised to refer to them as often as possible in order to remain familiar with them.

3. Description of the services provided.

The purpose of the website is to provide information regarding all the company’s activities.

EKIM strives to provide the most accurate information possible on the website. However, it cannot be held responsible for omissions, inaccuracies or deficiencies in updates, whether of its own doing or by any third parties providing this information.

All information provided on the EKIM website is for information only and subject to change. Furthermore, the information featured on the EKIM website is not exhaustive. The provided information is subject to any amendments that may have occurred since it was published.

4. Contractual limitations on technical data.

The website uses JavaScript technology.

The website cannot be held responsible for material damage related to the use of the website. The website user also agrees to access the website using the latest equipment that is virus-free, and with a recent, up-to-date browser.

5. Intellectual property and counterfeiting.

EKIM owns the intellectual property rights or has rights to use all the materials accessible on the website, specifically texts, images, graphics, logos, icons, sounds, and software.

Any reproduction, modification, publication or adaptation of all or some materials on the website, regardless of the means or process used, is prohibited without the prior written permission of: EKIM.

Any unauthorized use of the website or any of its elements shall be deemed an infringement and shall be prosecuted in accordance with articles L.335-2 et seq. of the French Intellectual Property Code.

6. Limitations on liability.

EKIM cannot be held liable for any direct or indirect damage caused to the user’s equipment during access to the EKIM website and resulting either from the use of equipment that does not match the specifications described in point 4 or from the occurrence of a bug or an incompatibility.

Likewise, EKIM cannot be held liable for indirect damage (such as the loss of a contract or of an opportunity) arising from use of the website.

Interactive spaces (providing the opportunity to ask questions in the contact area) are available to users. EKIM reserves the right to remove, without prior notice, any content posted in this space which may violate the applicable law in France, particularly the provisions relating to data protection. If applicable, EKIM also reserves the right to challenge the user’s civil and/or criminal liability, specifically in cases involving messages of a racist, offensive, libelous, or pornographic nature, irrespective of the medium used (text, photography, etc.).

7. Management of personal data.

In France, personal data are specifically protected by Act 78-87 of 06 January 1978, Act 2004-801 of 06 August 2004, Article L. 226-13 of the French Penal Code and the European Directive of 24 October 1995.

When using the website, the following information may be recorded: the URL of the links via which the user accessed the website, the user’s access provider, the user’s Internet Protocol (IP) address.

In any event, EKIM shall collect personal information about its users only for the purposes of the specific services offered by the EKIM website. Users provide this information with full knowledge of the facts, including when they enter it themselves. In this case, users of the EKIM website are informed of the obligation or not to provide this information.

In accordance with the provisions of articles 38 et seq. of Act 78-17 of 06 January 1978 on data processing, data files, and civil liberties, all users have the right to access, correct and oppose personal data concerning them by sending a signed, written request together with a copy of an identity document with the document holder’s signature, and specifying the address to which the reply should be sent.

No personal information relating to users of the EKIM website shall be published without the user’s knowledge, nor shall it be exchanged, transferred, assigned, or sold on any medium whatsoever to third parties. Only the acquisition of EKIM and its rights would allow the transmission of such information to the prospective purchaser who would in turn come under the same obligation to store and modify data about all users of the website.

Since it does not collect personal information, the website has not been declared to the French National Commission on Informatics and Liberty (CNIL).

Databases are protected by the provisions of the Act of 1 July 1998 transposing Directive 96/9 of 11 March 1996 on the legal protection of databases.

8. Hypertext links and cookies.

The website contains a certain number of hypertext links to other sites, set up with the authorization of EKIM. However, EKIM is unable to verify the content of the websites visited via these links, and therefore assumes no liability for them.

Browsing the website may cause one or several cookies to be installed on the user’s computer. A cookie is a small file, which does not allow the identification of the user, but which records information relating to the navigation of a computer on a website. The data obtained in this way is intended to facilitate subsequent navigation on the website, and also aims to enable methods for recording visitor numbers.

Refusal to install a cookie can lead to making some services inaccessible. However, in order to block the installation of cookies, users may configure their computers in the following manner:

In Internet Explorer: tool tab (the cog icon at the top right) / internet options. Click Privacy and select “Block all cookies”. Click on Ok to confirm.

In Firefox: at the top of the browser window, click the Firefox button, then go to Options tab. Click on the Privacy tab.

Configure the saving rules as follows: Use the custom settings for history. Finally, untick it to disable cookies.

In Safari: Click on the menu icon (cog symbol) in the top right hand side of the browser. Select Settings. Click on Show Advanced Settings. In the “Privacy” section, click on Content Settings. In the “Cookies” section, you can block cookies.

In Chrome: Click on the menu icon (three horizontal lines) in the top right hand side of the browser. Select Settings. Click on Show Advanced Settings. In the “Privacy” section, click on Preferences. In the “Privacy” tab, you can block cookies.

9. Applicable law and place of jurisdiction.

Any litigation relating to the use of the website is subject to French law. The competent courts of Paris are the exclusive place of jurisdiction.
